Passport Office

What to sent to USCIS as proof of citizenship when you already have us passport ?

Hi, I applied for GC based on marriage. My wife is US citizen but was born in Italy (US Navy hospital of Naples Italy). Her parents are both US citizen so by law she is US citizen and thus she has a valid US passport. USCIS web site says US passport is proof of citizenship but we got a request for proof of citizenship from them. What should we send ? Her birth certificate is from Italy.

  1. Consular report of birth abroad. FS-240
  2. Send a copy of her birth certificate.
  3. I was born in Europe on a military base as well. So here is the deal. When born overseas you get a birth certificate from that country. But you also report the birth to the Stae Department. Then you get another birth certificate that is issued by them. It is the same as a US based birth certificate (looks like one) and proof of US citizenship alone. So now you have two birth certificates. The birth certificate was FS-240 but has been replaced by DS-1350. It is still the same thing "Consular report of birth abroad". Go to the US State Dept. Passport site and search for that. They have to have a record of her and it is pretty easy to get a copy.
